Apple's Evidence Against Proview in iPad Trademark Dispute [Documents]

Numerous documents supporting Apple's case against Proview over the ownership of the iPad trademark have been posted online by AllThingsD.

Proview is now seeking $2 billion in damages from Apple for using the mark; however, Apple says it purchased the rights to the trademark but Proview refuses to transfer them over.

"We bought Proview's worldwide rights to the iPad trademark in 10 different countries several years ago. Proview refuses to honor their agreement with Apple, and a Hong Kong court has sided with Apple in this matter."

Additional documents obtained by AllThingD include email from a representative of Proview Technology - not the other affiliate - to Apple's representative regarding the deal, as well as a copy of the agreement itself.

One way to combat this shady practice of Proview is to call the iPad Apple iPad. Use the public court of opinion for support. In due time, Proview will disappear from the market as people in China will know what a real iPad is.

Item #8 of the agreement excludes trademarks referenced in Schedule A. China (and many other countries) are listed in Schedule A. Apple will loose with this evidence.

I had a Proview IPAD myself. Seems like people are interested in it so I put up some more photos of the unit on Picasa. https://picasaweb.google.com/108815326764525357704/ProviewIPAD It was a limited use 'Internet Appliance' despite its larger and bulky size. FYI - I've seen them running both MSN Companion 'OS' and a custom build of BeIA 1.0. As many know, BeOS had an interesting relationship with Apple. Ironic that the 1st / original 'IPAD' ran 2 of Apple's main competing OSes. Feel free to drop me a line with any questions.
