U.S. Judge to Dismiss Apple and Motorola Lawsuit With Prejudice

A Chicago judge has tentatively decided to dismiss an Apple and a Motorola lawsuit alleging patent infringement, reports Bloomberg.

The case was scheduled to go to trial in four days but U.S. Judge Richard A. Posner in Chicago today rejected each side's damages claims.

"I have tentatively decided that the case should be dismissed with prejudice because neither party can establish a right to relief," Posner said in a two-page written order, adding that he would delay entering final judgment until he writes a lengthier decision. "I may change my mind."

"I may change my mind" is not a comforting statement from a judge. Law should not be subject to the whim of an individual, in a just society. That it is only serves to expose the defects in the system.
