Potential iPhone and iPod Users in Liquid Damage Class Action Suit Now Being Contacted

Apple agreed to pay $53 million in May over refusing to service certain iPhones and iPods for free under AppleCare because of liquid water damage indicators that were tripped even though water did not contact them. 3M, who manufactures the strips, claimed that humidity alone could cause the white sensors to turn pink/red, thus making the service representative think the device was submerged in water.

The iPhone 3G and iPhone 3GS, the iPhone, the original iPod touch, the iPod nano, the iPod classic, and the third-generation iPod shuffle are all covered in the suit. Therefore, if you had one of these devices and were refused service under AppleCare because of your water sensor, you could be entitled to a payout from Apple

To qualify for a cash refund, you must: (a) be a United States resident; (b) Apple denied warranty coverage for your iPhone on or before December 31, 2009, OR for your iPod touch on or before June 30, 2010; (c) when it was submitted to Apple for warranty coverage, your iPhone or iPod touch was covered either by its original one-year limited warranty or by an AppleCare Protection Plan; and (d) Apple denied warranty coverage because Apple stated that your iPhone or iPod touch had been damaged by liquid.

Actually, my daughter's Touch was in a waterproof case and the moisture strip still went off, so it's not a BS argument. What's worse, she bought her Touch using Christmas and birthday money on 12/26/09. It stopped working in September and Apple denied warranty coverage. But because the lawsuit is saying claims must be made prior to June or you don't qualify, so she has a Touch she can't use and won't get a thing.
