German Appeals Court Lifts Injunction Against Apple Over Push Email

A German appeals court has lifted an injunction preventing Apple from pushing email to iCloud users in the country, reports FOSS Patents. The site notes that Google, despite its acquisition of Motorola three years ago, now has zero injunctions enforced against Apple or Microsoft.

I already mentioned in my previous post (on the Microsoft-Nokia deal) that a spokesman for a German appeals court has confirmed to me that Motorola's push notification injunction -- the only patent injunction Motorola has recently been enforcing against Apple -- has been stayed. Shortly before finishing the previous post, I called a spokesman for the Oberlandesgericht Karlsruhe (Karlsruhe Higher Regional Court), who was able to confirm to me officially that this appeals court granted an Apple motion stay the enforcement of the Mannheim Regional Court's February 2012 injunction.

Apple can give back the push email feature to German users as soon as it posts a bond ensuring Motorola can collect damages should it prevail in further litigation. This is expected to occur within a few days. Notably, should Apple prevail in litigation it could now collect damages from Google for enforcement of an injunction that should not have been granted.
