Apple Tells Another App Store to Stop Calling Themselves an 'App Store'

Posted March 22, 2011 at 10:19pm by iClarified
Apple has sent a cease-and-desist letter to MiKandi, an adult novelties store that describes itself as "the world's first app store for adults", according to MacNN.

The MiKandi app store is itself an app that can be installed on Android smartphones. Customers can pay a third-party that converts their money into "points" that then qualify for downloading adult apps from within the app.

Apple believes it has ownership of the 'app store' term and looks to be legally attacking anyone who uses the words. On March 18th Apple filed a lawsuit against Amazon for use of the term.

MiKandi plans to ignore the request for now, pending the result of Microsoft's challenge to Apple's trademark registration.

Actually, Apple can't do that because they were not given the copyright.

Actually they can. In the U.S. if you use a name in commerce whoever uses it first is automatically granted ownership of the mark. It doesn't matter if you registered it. The issue here is that 'app store' is likely to descriptive to qualify as a registrable mark.
