Sony Takes Geohot to Court Over PS3 Jailbreak [Update x2]

Sony has just filed a restraining order against Geohot and members of team fail0verflow for jailbreaking the Sony Playstation 3.

Defendants George Hotz, "Bushing," Hector Cantero, Sven Peter and "Segher" (collectively, "Defendants") are computer hackers. Working individually and in concert with one another, Defendants recently bypassed effective technological protection measures ("TPMs") employed by plaintiff Sony Computer Entertainment America LLP ("SCEA") in its proprietary PlayStation 3 computer entertainment system ("PS3 System"). Through the Internet, Defendants are distributing software, tools and instructions (collectively, "Circumvention Devices") that circumvent the TPMs in the PS3 System and facilitate the counterfeiting of video games. Already, pirated video games are being packaged and distributed with these circumvention devices. Declaration of Ryan T. Bricker In Support of Ex Parte Motion for Temporary Restraining Order And Order To Show Cause Re Preliminary Injunction; Order for Impoundment ("Bricker Decl.") ¶2, Exh. A. Pursuant to Federal Rule of Civil Procedure 65 and Local Rules 65-1 and 7-10, SCEA moves ex parte to put an immediate halt to the ongoing distribution of these illegal Circumvention Devices and avoid irreparable harm to SCEA and to other video game software developers stemming from video game piracy.

Hopefully the courts will use the same logic that Library of Congress Copyright Office used when ruling that iPhone jailbreaking was legal. "When one jailbreaks a smartphone in order to make the operating system on that phone interoperable with an independently created application that has not been approved by the maker of the smartphone or the maker of its operating system, the modifications that are made purely for the purpose of such interoperability are fair uses."

Update:
Sony's filings are for a temporary restraining order that demand all information about the jailbreak be removed from the web. A full lawsuit is expected in a few days time.

Update x2:
Looks like that lawsuit is here. Geohot has posted a new "Complaint" filed by Sony in which they request "injunctive relief and damages based on Defendants' unlawful circumvention and distribution of circumvention devices in violation of the Digital Millennium Copyright Act"

Think twice before you post! People buying games and making them available to others via jail-broken PS3 or PSP so they don't pay, Sony loses money that could be the motivation to create something new or to pay its employees. So it's like being a thief to steal something from others instead of paying. Yes, if you pay - you do whatever you want with your game or console, but do not share with others, they also have to pay for the work that was done by Sony and other involved employees. Imaging Sony spent millions for developing console and game and got just 10% of profit back? They will just close and you will not play games anymore. Same with other companies. This is the process of money flow that makes our economy stronger, not weaker.

This is bullshit. We can do anything that we want to our electronics. Sony shouldn't involve in this. No matter what we do, we still buy sony products. It doesn't matter jailbreak or not we still buy it. We buy the stuff. What ever we do, sony should get in what we do. Well, I think sony is being jealous.

Sony's concern is is piracy of games not the hardware. Think about it if you made software to make money and set a price for that software and someone manage to crack it and sell it dirt cheap wouldn't you be angry? Plus sony has to show their share holders and software partners that they are doing something about it.

so basically sony is saying that once i buy a car I am not allowed to modify it at all. Perhaps and performace chip or a cold air intake? So sony is saying that GM and Honda can sue me if I modify my car?? I was going to buy more sony products but trying to sue Geohot has convinced me not to buy anymore sony electronics.

This is to inform all hardware manufacturers; Apple, Sony et al that once I've paid in full for my device manufactured by your companies, it is mine to do as I please and that is not just limited to jailbreaking, shoving in front of a speeding train, dropping it into the ocean amongst many other things that I could do with your devices. In simpler terms, it's mine to do as I please. And we all stand with our heads held high with jailbreakers, unlockers not limited to George Hotz and The Dev Team.
