Apple Must Pay $1.2 Million Fine After Losing Appeal in AppleCare Complaint

Apple must pay a $1.2 million fine after an Italian appeal court ruled that Apple was misleading customers on product warranties, reports Repubblica.

First they would not have informed "in an appropriate way consumers on rights of free assistance provided by the biennial consumer code, impairing their exercise and limiting ourselves to recognize the manufacturer's standard warranty of 1 year ", and secondly, the" information given on the nature, content and duration of support services to additional payment applecare protection plan, coupled with the lack of clarification on the existence of the legal guarantee two years, were such as to induce consumers to sign an additional contract when the 'cover' of service Payment overlaps in part to the legal guarantee provided free by the Consumer Code.

Consumer groups in eleven countries have written letters to national regulators asking them to put a stop to Apple's misleading advertising on product warranties. Apple products indicate they come with a one-year warranty when European Union law says they must cover goods for two years. The consumer groups say Apple is misleading customers into purchasing extended warranties when they are already covered by law.

I sincerely hope that this money is going back to the consumers. It would horrible if it's going to the government or worse, the firm that sued.

I was told by Apple that the 2nd year is covered by the network operator presuming it is subsidized by them.... However I never buy subsidized iPhones so when mine went tits up just outside it's 1st year I had to pay over €200+ for a replacement :@

That's only if you are in the EU or related nations. Why didn't apple just "bundle" AppleCare as mandatory in their unit sell price? If it wasn't purchased in these locations, the "extended" warranty wouldn't apply anyway.

This I why I never buy AppleCare .... Ever!! If it breaks before then... Sue and buy another apple product with the returns.
