Apple Agrees to License Motorola FRAND Patents in Germany

Apple has reportedly agreed to license Google/Motorola Mobility's FRAND patents in Germany, according to a FOSS Patents report.

In a filing made late on Monday (August 27, 2012) with the United States District Court for the Southern District of California, the Google subsidiary has now confirmed the recent conclusion of a standard-essential patent license agreement with Apple. Under the agreement, Apple is now licensed to use some if not all of Motorola's standard-essential patents in Germany, though the parties have not yet agreed on a FRAND royalty rate, which will ultimately have to be set by German courts unless they agree on a rate prior to its judicial determination.

Notably, this means that any further action against Apple would have to rely on non-standard-essential patents such as Motorola's push email patent.

Thus, Google (Motorola) will likely push for as high a royalty as possible; however, the limit will be 2.25%.

Great. What's fair is fair. Apple has patents and won against Samsung. Motorola has patents and Apple is paying. Sounds like these corps are playing nice....at least for now. Motorola's patents aren't shit or else Apple wouldn't be using them. I'm talking to you Miss Samsung=Shiite. Grow a brain when posting or don't post at all.
