Apple Denied Preliminary Injunction Against Samsung in the U.S.

Apple's request for a preliminary injunction against Samsung Galaxy devices in the U.S. has been denied, reports Electronista.

Samsung clinched an important win late Friday after Northern District of California Judge Lucy Koh denied Apple's call for a preliminary ban on key Android devices. The San Jose court told Apple that the Droid Charge, Galaxy S 4G, Infuse 4G, and Galaxy Tab 10.1 would have to stay on sale unless Apple won at the full trial.

Judge Koh didn't reject that Apple had a valid case against Samsung; rather she rejected that the situation was urgent enough to issue a preliminary injunction. "It is not clear that an injunction on Samsung's accused devices would prevent Apple from being irreparably harmed," she said.

In Australia, Samsung recently appealed the injunction awarded to Apple and won. Now Apple asking the High Court to hear their appeal in an effort to prevent the injunction from being overturned.
