As expected, Apple has filed court documents denying any misconduct by juror Velvin Hogan during its case against Samsung in California. The company also denied any prior knowledge of Hogan's litigation with Seagate, reports AllThingsD.
“Apple does not accuse juror Velvin Hogan of misconduct — because there was none — so what Apple knew and when regarding Mr. Hogan’s lawsuit with Seagate nearly two decades ago is irrelevant to any issue raised by Samsung’s post-trial motions,” the company said in its filing. “Apple does not contend that any past relationship between Mr. Hogan and Seagate, or any lawsuit between them, is anything remotely close to support a challenge for cause.”
Samsung is looking to invalidate Apple's win by accusing the juror of not disclosing information about his past.
Hogan denies that there was any misconduct saying that court instructions required disclosure of any litigation they were involved in within the last 10 years. Since the bankruptcy and related litigation involving Samsung was in 1993, it fell well outside that time range.
Thursday, U.S. District Judge Lucy Koh will hold a hearing on the matter.
