Apple Loses Appeal Over iPhone Trademark in Mexico

Apple has lost an appeal over the Ifone trademark in Mexico opening itself up to an infringement lawsuit filed by the company, report the WSJ.

According to the Journal, when Apple tried to file for the 'iPhone' trademark in Mexico they were told by the Mexican Industrial Property Institute that the name was already taken.

Apple sued to have the Ifone brand revoked on grounds it had expired for the Mexican company, but a federal court found that Ifone SA, registered in 2003, was making proper use of it. The Supreme Court this week rejected Apple's appeal against the decision at the request of Ifone.

The company's lawyer says they have already submitted a claim for damages resulting from use of its name by Apple and cellular carriers in the country.
