Apple and Amazon Ordered Into Settlement Talks Over 'App Store' Term

Apple and Amazon have been ordered into settlement talks in Apple's trademark infringement lawsuit against Amazon for using the term 'app store', reports Bloomberg.

U.S. Magistrate Judge Elizabeth Laporte in San Francisco directed the companies to confer on March 21 and to bring their lead attorneys and people who have full authority to negotiate and settle the case, according to a court filing today. A trial is scheduled for August.

Apple is claiming to have ownership of the term 'app store'. The company attempted to trademark the term 'App Store' three times. The first two times their application was rejected due to its descriptive nature. Apple even tried to argue that App was short for 'Apple'. The third time and 400 exhibits later the application was allowed and immediately opposed by Microsoft. Shortly after, Apple began threatening (2) and suing companies over use of the term including Amazon.

Amazon recently won a dismissal of Apple's lawsuit against the company for alleged false advertising over its use of the term 'app store'.
