Apple Forbids iPhone Developers From Jailbreaking

Posted April 1, 2009 at 3:01pm by iClarified
The latest iPhone SDK agreement now forbids developers from jailbreaking or creating apps for jailbroken phones, according to an ArsTechnica report.

The new iPhone Developer Program License Agreement states the following:

(e)You will not, through use of the Apple Software, services or otherwise, create any Application or other program that would disable, hack or otherwise interfere with the Security Solution, or any security, digital signing, digital rights management, verification or authentication mechanisms implemented in or by the iPhone operating system software, iPod touch operating system software, this Apple Software, any services or other Apple software or technology, or enable others to do so; and

(f) Applications developed using the Apple Software may only be distributed if selected by Apple (in its sole discretion) for distribution via the App Store or for limited distribution on Registered Devices (ad hoc distribution) as contemplated in this Agreement.

This means that registered developers can no longer jailbreak their own phones or help others to jailbreak their phones. Developers are also forbidden from using the iPhone OS, SDK, and any other developer tools to create applications that are distributed anywhere but the App Store or via Ad Hoc distribution

Heck Yea! There is nothing that would stop me from using EVERYTHING that my iPhone is capable of. I have a 1st gen- paid $400 and I am STILL getting my moneys worth. Its been jailbroken.. I can do things with my phone that are astonishing to my newly-converted iphone friends. WHY WOULDNT I JAILBRAK IT?!?

And how would they know this? They have jailbroken iphones and know which developers create apps on both App Store and Cydia.

Ha, I'd still do it, why shouldn't I make the most of my iPhone just because Apple can't make what we can due to legal stuff. Like I and some other people say, what Apple (or some person) doesn't know, can't hurt us!

This is just stupid. Apple doesn't like it because there are great apps on Cydia, Like Cycorder and Winterboard. Unless they implement all these great features in another version which cydia offers, nothing will stop the jailbreak community. Also whats with MMS not working on the original iPhone. It has worked for ages on my original iPhone thanks to swirely mms :S. .:T:.

This means nothing, when you install any software etc you must accept terms, doesn't stop you breaking them

Apple can place any conditions they like, but they may not stand up to legal challenges. If Apple make their development software available to a developer, I can't see how they can successfully prevent a developer doing what he/she likes with it. Apple can say that if we find out a developer has been developing for Jailbroken phones, then we won;t let them publish to the Appstore, but hard to see how they can defend just saying "you can't develop jailbroken apps", especially when Jailbroken has not been found to be illegal in a court, it's only stated to be illegal by Apple. Let the court challenges roll on. I maintain that Apple needs the jailbroken community, and they know they need it.
