EU Justice Commissioner Calls For Examination of Apple Warranty Practices

EU Justice Commissioner Viviane Reding has written to member countries asking them to examine whether Apple failed to inform customers of their right to a minimum two-year warranty, reports Bloomberg.

"Apple prominently advertised that its products come with a one-year manufacturer warranty but failed to clearly indicate the consumers' automatic and free-of-cost entitlement to a minimum two-year guarantee under EU law," Reding said to ministers in the letter, which was obtained by Bloomberg News. "These are unacceptable marketing practices."

Italy's AGCM competition and market authority has already imposed fines of 900,000 euros on divisions of Apple for failing to tell customers about their rights to free assistance.


Apple has declined to comment on the matter.

What has the price got to do with it? All manufacturers have to provide a 2-year warranty in EU - no exceptions. Period. Is the iPhone expensive in EU? Compared to US - yes. Compared to Brasil - no. Do Bralisians get 2-years warranty - no.

No I'm not complaining on getting a new phone because I tried contacting the original owner but I had no luck so i might as well get it swapped out rather than leave it as a paper weight since Apple lets me do that. But let's say you lost your iPhone and someone bought it on Craigslist or off some guy on the street,would you want to give whoever has your phone the option to swap it out for a new one that they can use when it wasn't theirs to begin with? Meanwhile your with out a phone and they has a fully working clean esn iphone.

Apple needs to do more than fix that. They don't even check id when they do warranty swaps. Technically you can take any iPhone to an Apple store and tell them you want it replaced because of the home button getting stuck or something of that sort. They will swap it out within the one-year warranty for free, or you pay $149-$199 if you are out of warranty. Meaning, if you made the mistake of buying an iPhone on Craigslist or eBay that has been reported either lost or stolen from the carrier, you can make an appointment at your local Apple store using a dummy Apple id and have them give you a replacement. The way i found this out was because I was tricked into buying a "bad esn" iPhone off Craigslist. I took it to Apple and told them the home button gets stuck and its uresponsive sometimes. They replaced for a "clean esn" iPhone WITHOUT checking id. All they looked at was the serial number and told me it was out of warranty so I payed $149 for the replacement. They never mentioned anything about it being lost or stolen. I don't think they can even see that in their system. I think that's their biggest flaw when it comes to warranty swaps.
