Apple has confirmed an issue experienced by some users when trying to update their Apple TV to iOS 5.1.1 over Ethernet.
Symptoms In rare instances, Apple TV (2nd and 3rd generation) models using Apple TV Software 5.1 may be unable to play certain content using an Ethernet connection. Content may include: ● Hulu Plus ● MLB ● NHL ● YouTube ● Photo Stream ● WSJ Live
This issue may also prevent you from installing Apple TV software updates using an Ethernet connection.
Resolution This issue affected a small number of routers and switches and is resolved in Apple TV Software 5.1.1.
If you are unable to install the update using an Ethernet connection, disconnect your Ethernet connection temporarily and use a Wi-Fi connection to update.

then rather sell the jailbreakable atv2 (and buy atv3) - since you'll get more money for the atv2 than a brandnew atv3 costs :p

If so, I'll trade you for your 2 and give you an unJailbreakable ATV3 (magic 1080p), and pay the S/H. My eyes are bleeding from looking at firmware code to make this more than a hockey puck. Give it another month, and I'm gonna buy a Pi kit, or even better the Pivos Xios. I love Frodo XBMC on my ATV 2, want the 1080 (I know most play at 720 anyway, but not all)
